Please allow me to take a moment of your time to give you an update and

reminders about the Legal Plan. Please make sure your State's Lodges have

the most current information! There is still some confusion and

misunderstanding with regard to WHAT a claim can be made for, HOW to make a

claim and WHO to contact when making a claim. Please feel free to direct

all questions about the Plan to my attention.

The Plan is devoted to defending individual participant FOP members against

administrative proceedings, civil lawsuits and criminal prosecutions

alleging they committed wrongful acts directly related to the course and

scope of their law enforcement employment. The Plan is NOT designed for

generalized contract disputes affecting an entire department and not

arising from wrongful conduct.

Please note, the incident in which the investigation/discipline stems from

must have occurred after the retroactive date and before coverage

effectively ends to be considered for coverage compensability.

Please see the ATTACHED current CLAIM FORM. If the incorrect form is used,

I cannot accept it. Just today I received a claim that was submitted on a

SUMMIT RISK form! Please make sure the Lodges and their respective website

retain the correct form.

Claims must be submitted within 30 days from the date an officer is

notified they are being investigated.

If a claim is denied, a written request for an appeal to the Board of

Trustees must be submitted within 30 days from the date of the denial to be

effective. The Board's decision is final and not subject for further

appeal or review.

The most current Plan Attorney listing is updated on the website at the

first of every month. To view the Plan Attorney list, please visit

www.fophylant.com or you can contact me directly. You may use any attorney

you choose, even if the attorney is not on the Plan. If a "Non-Plan

Attorney" is used, there are coverage limitations and a $250 deductible.

However, any Non-Plan Attorney may join the Plan at any time. Please have

that attorney contact me directly for a Plan Attorney packet.

For the Salary Reimbursement Option (SRO), a claim must be submitted within

30 days from the date of the suspension for the claim to be considered.

Reimbursement is based on 8-hours per day. This Option is in lieu of legal

costs for the suspension. No further claims can be made after taking the

Option for that specific incident or similar incident resulting in

suspension. If attorneys fees exceed $500, the Option is no longer

available. The election may not be rescinded or reversed with respect to

the claim or other related claims after the reimbursement benefit is paid.
